RE-USE OF GREENFIELD SOIL – A NORTHERN IRISH PERSPECTIVE

In June we reported on a Court of Appeal ruling that soil excavated during site preparations was ” controlled waste” and could not be re-used elsewhere without a Waste Management Licence (“Once waste, always waste?” 16 June 2010) Now, in a further contribution to the debate, the Northern Ireland Environment Agency has just issued its Guidance on the Regulation of Greenfield Soil in Construction and Development.

ONCE WASTE ALWAYS WASTE? THE PERILS OF BRINGING EXTRA SOIL ON TO YOUR LAND

It must have seemed an eminently sensible arrangement at the time: farmers needed to regrade a sloping part of their farmland to enable the construction of a new farm building; excavations in the course of site preparation for a hotel development on a nearby farm had resulted in the availability of some 9,000 tonnes of soil and subsoil. As an added bonus the farmers were paid for receiving the soil.

GOVERNMENT CONSULTS ON CUTTING CONNECTION BACKLOG FOR RENEWABLE ENERGY PROJECTS

The Government’s Department of Energy and Climate Change, aware of the UK commitment to ensure by 2020 that 40% of electricity generated nationally is from renewable or other low carbon sources, has turned its attention to the significant barrier to investing in renewable energy projects resulting from the uncertainty and delays in ensuring that the energy generated can be fed into the national grid.

NEW LEGISLATION TO TACKLE VAT FRAUD ON CARBON CREDITS

The UK Government has introduced legislation effective from midnight on 31 July 2009, which removes VAT from European Emission Allowances (also known as “carbon credits”) traded within the UK.
